1. Limitation of liability. 

No liability. Subject to applicable law, including with respect to liability for personal injury or non- waivable statutory rights under UK law, in no event shall Legacies Apparel© or its officers, directors, employees, shareholders or agents (A) be liable to the user with respect to use of the sites, the content or materials contained in or accessed through the sites (including without limitation any damages caused by or resulting from reliance by a user on any information obtained from Legacies Apparel©), or any damages that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of God, communications failures, theft, destruction, or unauthorised access to Legacies Apparel© records, programs or services; and (B) be liable to the user for any indirect, special, incidental, consequential, punitive, or exemplary damages, including, without limitation, damages for loss of goodwill, lost profits, loss, theft or corruption of user information, or the inability to use the sites or any of their features. The user’s sole remedy is to cease use of the sites. To the fullest extent permitted by law, neither Legacies Apparel©, nor our employees or directors or agents shall be liable to you for any lost profits or revenues, or for any consequential, incidental, indirect, special, or punitive damages arising out of or in connection with the services or these terms.

 

2.  Product Information.

All Legacies Apparel© products displayed at the site are available only while stocks last. The prices displayed at the site are quoted in US Dollars and are valid and effective only in the United States.

 

3.  Warranties.

Legacies Apparel© services are provided “as is” and without any kind of warranty (express or implied). We are expressly disclaiming any warranties of title, non-infringement, merchantability, and fitness for a particular purpose, as well as any warranties implied by a course of performance, course of dealing, or usage of trade. 

 

4.  Intellectual Property and Trademarks.

The intellectual property rights in all software and content made available to you on or through this website remains the property of Legacies Apparel© or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by Legacies Apparel© and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, and of the content or copies of the content supplied to you or which appears on this website nor may you use any such content in connection with any business or commercial enterprise. You shall not modify, translate, reverse engineer, decompile, disassemble or create derivative works based on any software or accompanying documentation supplied by Legacies Apparel© or its licensors. 

 

5.  Pricing and payment terms.

The price of Legacies Apparel© products is as quoted on the site from time to time. Prices include VAT but exclude delivery costs, which will be automatically added (at the cost shown) to the total amount due when you view the items in your shopping basket, and have selected your chosen different delivery method. Prices and delivery costs are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a dispatch confirmation. The site contains Legacies Apparel© products and it is always possible that, despite our best efforts, some of the Legacies Apparel© products listed on the site may be incorrectly priced. We will normally verify prices as part of our despatch procedures so that, where a Legacies Apparel© product correct price is less than our stated price, we will charge you the lower amount. If a Legacies Apparel© products correct price is higher than the price stated on the site, we will normally, at our discretion, wither contact you for instructions before despatching the Legacies Apparel© product, or reject your order and notify you of such rejection. Payment for all orders must be made by credit or debit card on the checkout page. We accept payment by most major credit and debit cards. You should be aware that online payment transactions are subject to validation checks by your card issuer and we are not responsible if your card issuer declines to authorise payment for any reason. We also carry out a standard pre-authorisation check on your payment card, and Legacies Apparel© products will not be despatched until this pre-authorisation check has been completed. Please note, it is possible that your card issuer may charge you an online handling fee or processing. We are not responsible for this. 

 

6.  Dispute resolution.

You agree that all matters relating to your access to or use of the site, including all disputes, will be governed by the laws of the United Kingdom. Any claim under these terms of use must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorney’s fees. In the event of any controversy or dispute between Legacies Apparel© and you arising out of or in connection with your use of the site, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.
